These terms govern your use of AIFlow Solution's AI automation services. Please read them carefully before using our platform.
Important Notice
By accessing or using AIFlow Solution's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "You", or "Your") and AIFlow Solution Sdn. Bhd. ("AIFlow", "We", "Us", or "Our") regarding your use of our AI automation services, platforms, and related software (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. Description of Services
AIFlow Solution provides AI-powered automation services designed to streamline business operations through:
- Workflow Automation: Custom n8n-based automation solutions
- AI Integration: Artificial intelligence tools for data processing and decision-making
- Business Process Optimization: Industry-specific automation bundles
- Platform Integration: Connecting various business applications and systems
- Consultation Services: Strategic guidance on automation implementation
3. Subscription Plans and Pricing
3.1 Subscription Tiers
We offer multiple subscription plans:
- Basic Plan: RM500/month - 3 automation workflows
- Standard Plan: RM1,000/month - 8 automation workflows
- Premium Plan: RM2,000/month - 15 automation workflows
- Enterprise Plan: Custom pricing - Unlimited workflows
3.2 Billing and Payment
- Subscriptions are billed monthly in advance
- All prices are in Malaysian Ringgit (RM) and exclude applicable taxes
- Payment is due within 30 days of invoice date
- We accept bank transfers, credit cards, and other approved payment methods
- Late payments may result in service suspension
3.3 Price Changes
We reserve the right to modify our pricing with 30 days' written notice. Price changes will apply to your next billing cycle after the notice period.
4. User Responsibilities
4.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized access
- Using strong passwords and enabling two-factor authentication where available
4.2 Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You will not:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Transmit malicious code or attempt to harm our systems
- Use the Services to spam or send unsolicited communications
- Attempt to reverse engineer or compromise our platform security
- Share your account credentials with unauthorized parties
4.3 Data Accuracy
You are responsible for the accuracy and quality of data you provide to our Services. We are not liable for automation results based on inaccurate or incomplete data.
5. Intellectual Property Rights
5.1 AIFlow's Intellectual Property
All rights, title, and interest in and to the Services, including all software, algorithms, documentation, and proprietary technologies, remain the exclusive property of AIFlow Solution. You receive only a limited, non-exclusive license to use the Services as described in these Terms.
5.2 Your Content
You retain ownership of all data, content, and information you provide to our Services ("Your Content"). By using our Services, you grant us a limited license to process Your Content solely to provide the Services.
5.3 Feedback
Any feedback, suggestions, or improvements you provide regarding our Services may be used by us without restriction or compensation.
6. Privacy and Data Protection
Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the Malaysian Personal Data Protection Act 2010 (PDPA) and international data protection standards.
7. Service Level Agreement (SLA)
7.1 Uptime Guarantee
We strive to maintain 99.5% uptime for our Services, calculated monthly. Scheduled maintenance is excluded from this calculation.
7.2 Support Response Times
- Basic Plan: Standard support - 48-hour response time
- Standard Plan: Priority support - 24-hour response time
- Premium Plan: Dedicated support - 12-hour response time
- Enterprise Plan: 24/7 dedicated support - 4-hour response time
7.3 Service Credits
If we fail to meet our uptime guarantee, you may be eligible for service credits as outlined in your specific service agreement.
8. Limitation of Liability
To the maximum extent permitted by Malaysian law:
- AIFlow Solution shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claims related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for damages caused by your misuse of the Services or failure to follow our guidelines
- We do not guarantee specific business outcomes or cost savings from using our automation services
9. Indemnification
You agree to indemnify, defend, and hold harmless AIFlow Solution, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services in violation of these Terms
- Your violation of applicable laws or third-party rights
- Your Content or data provided to our Services
- Your negligence or willful misconduct
10. Termination
10.1 Termination by You
You may terminate your subscription at any time with 30 days' written notice. You remain responsible for all charges incurred up to the termination date.
10.2 Termination by Us
We may terminate or suspend your access to the Services:
- Immediately for breach of these Terms
- With 30 days' notice for non-payment
- With 30 days' notice for business reasons
- Immediately for illegal activities or security threats
10.3 Effect of Termination
Upon termination, your access to the Services will cease, and we will provide a reasonable period for you to retrieve your data. We are not responsible for data retrieval after the specified period.
11. Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, internet service provider failures, or other unforeseeable events.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia, specifically the courts of Kuala Lumpur.
13. Dispute Resolution
13.1 Negotiation
Before initiating formal proceedings, parties agree to attempt good faith negotiations to resolve any disputes.
13.2 Mediation
If negotiation fails, disputes shall be submitted to mediation under the rules of the Malaysian Mediation Centre.
13.3 Arbitration
If mediation is unsuccessful, disputes shall be resolved through binding arbitration under the Arbitration Act 2005 of Malaysia.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Posting updated Terms on our website
- Sending email notifications to registered users
- Providing in-app notifications through our platform
Your continued use of the Services after the effective date of changes constitutes acceptance of the modified Terms.
15. Entire Agreement
These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and AIFlow Solution regarding the use of our Services. These Terms supersede all prior or contemporaneous communications and proposals between the parties.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely matches the intent of the original provision.
17. Waiver
The failure of either party to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by that party in writing.
18. Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
